These Terms and Conditions govern your use of our hackathon platform and services. Please read these terms carefully before using our platform.

Introduction

This Terms of Use Agreement (“Agreement”) is a legally binding contract between you, whether individually or on behalf of an entity (“User,” “You,” or “Developer”), and Fluxor (“Fluxor,” “Company,” “we,” “our,” or “us”), governing your access to and use of the Fluxor Hackathon Platform, including the website, mobile applications, and any related services (collectively, the “Services”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not access or use the Services.

Arbitration and Dispute Resolution

To the maximum extent permitted by law, disputes between you and Fluxor will be resolved through binding, individual arbitration as outlined in the “Disputes and Governing Law” section below. By accepting this Agreement, you waive your right to a trial by jury and to participate in any class action or representative proceeding.

Eligibility

You may only register for or use Fluxor’s services if you have the legal capacity to enter into binding contracts and are not a resident of any restricted or prohibited jurisdiction. Users who are minors in their jurisdiction (generally under 18) may only use Fluxor with the consent and supervision of a parent or legal guardian. Persons under 13, or under 16 if residing in the UK or EU, are not permitted to register or use Fluxor’s services. By registering, accessing, or using Fluxor, you confirm that you meet these eligibility requirements and agree to be bound by this Agreement.

User Responsibilities

When using Fluxor’s services, you agree not to: • Reverse engineer, decompile, disassemble, or copy Fluxor’s platform (except where permitted by law). • Modify, translate, or create derivative works based on Fluxor’s software. • Misuse the services for unlawful, fraudulent, defamatory, or abusive purposes. • Upload or share content that is pornographic, threatening, hateful, offensive, or inappropriate. • Violate data protection, privacy regulations, or export restrictions. • Use Fluxor beyond your authorized scope or to develop competing services. • Send spam, impersonate others, or misrepresent your identity. • Disclose another user’s personal information without authorization. • Share accounts, login credentials, or enable unauthorized access. Violation of these restrictions may result in suspension or termination of your account.

Intellectual Property

Fluxor owns all rights in its platform and pre-existing materials. Users retain ownership of their submissions but grant Fluxor and hackathon organizers a limited license to use them for hackathon purposes. By submitting a project, you grant organizers a non-exclusive license to review, judge, and showcase the project for hackathon purposes. Fluxor does not claim ownership of user-generated content. Users must comply with applicable laws and third-party terms.

Limitation of Liability

To the fullest extent permitted by law, Fluxor and its affiliates will not be liable for indirect, incidental, punitive, or consequential damages (such as loss of profits, data, or business interruption). Fluxor’s total liability will not exceed the greater of (i) the amount you paid to Fluxor in the three months prior to the claim, or (ii) USD $100. Fluxor is not liable for: • Losses or damages from hackathon outcomes or organizer actions. • Technical issues, outages, or breaches beyond reasonable control. • Disputes with organizers, sponsors, or participants.

Termination

Fluxor may suspend or terminate your account and remove your content if you violate these Terms or act inconsistently with their purpose. You may terminate your account at any time via settings or by contacting support. After termination, you lose access to your account, and your content may be deleted. Provisions like intellectual property, liability limits, and dispute resolution will survive termination.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Users outside India are responsible for compliance with their local laws.
